ባልና ሚስት በፍቺ ወቅት የጋራ ንብረታቸውን ለመካፈል ስምምነት ላይ ያልደረሱ ከሆነና ንብረቱ በአይነት ሊካፈል የማይችል እንደሆነ ንብረቱ ተሸጦ የተገኘውን ዋጋ እኩል እንዲካፈሉ መደረግ ያለበት እንጂ በእጣ እንዲካፈሉ ሊወሰን የሚችልበት የህግ አግባብ የሌለ ስለመሆኑ የተሻሻለው የቤተሰብ ህግ አዋጅ ቁ. 213/92 አንቀጽ 103/1/
