ከጭብጥ አያያዝ ጋር በተገናኘ በአንድ ወገን ተቆጥሮ የቀረበን ማስረጃ ለጉዳዩ አግባብነት የለውም በሚል ወይም ህጋዊ ተቀባይነት ባለው ሌላ ምክንያት መሰማት አይገባውም የሚል ግልፅ ትእዛዝ ሳይሰጥበት የክርክሩ ጭብጥ በአንደኛው ወገን ማስረጃ ላይ ብቻ ተመስርቶ ውሳኔ እንዲያገኝ መደረጉ ተገቢ የክርክር አመራር ስርዓት ስለመሆኑ፣ የፍ/ብ/ሥ/ሥ/ሕ/ቁ. 255፣257፣258፣259
