በሌላ ሰው የስራ ድካም ወይም የሌላ ሰው ሃብት በሆነ ነገር በመገልገል በቂ ባልሆነ ምክንያት ጥቅም ያገኘ ሰው አለአግባብ ጥቅም ባገኘበት መጠን ለባለሃብቱ ወይም ጉልበቱ ለደከመው ሰው ይህ አድራጎት ባደረሰበት ጉዳት መጠን ኪሳራ መክፈል የሚገባው ስለመሆኑ
