የዕርቅ ስምምነት ውል እንደዉሳኔ ተቆጥሮ በፍርድ ቤት ለአፈፃፀም አቅርቦ ለማስፈፀም ስምምነቱ ግልጽና የፈፃሚዉን አካል ግዴታ በማያሻማ ሁኔታ የሚገልጽ መሆን ያለበት ሲሆን ግልጽ ያልሆነ የእርቅ ስምምነት ሲቀርብ፣ ጉዳዩ የቀረበለት ፍርድ ቤት የሌላ ተከራካሪ ወገን ክርክር እንኳ መስማት ሳያስፈልገዉ ክሱን ዉድቅ ማድረግ የሚችል ስለመሆኑ
