የአሰሪና ሠራተኛ አዋጅን መሠረት አድርጐ ከሚቀርብ ክርክር ጋር በተገናኘ በግልፅ ዳኝነት ተጠይቆበት ውሣኔ ሣይሰጥ ከተጠየቁት ዳኝነት መካከል ወደ ሥራ የመመለስ ጉዳይ ላይ ብቻ ውሣኔ ከተሠጠና ሠራተኛው ወደ ሥራ መመለስ ሳይፈልግ ቢቀር ቀድሞ ዳኝነት በጠየቀባቸው ነገር ግን ውሣኔ ባላረፈባቸው ነጥቦች ላይ ዳኝነት ሊጠየቅ የሚችል ስለመሆኑ አዋጅ ቁ. 377/96 አንቀፅ 43(3)
