በአንድ ወቅት የነበረን የተገነባ የመንገድ ደረጃ መነሻ (መሠረት) በማድረግ በመንገዱ ግራ ቀኝ አዋሣኝ በሆነ ይዞታ ላይ ተገቢውን ርቀት በመጠበቅ ንብረትን ያፈራ ሰው በሌላ ጊዜ የመንገዱ ደረጃ ከፍ እንዲል በመደረጉ የተነሣ በአዋሣኝ ይዞታው ላይ ግለሰቡ ያፈራቸው ንብረቶች ላይ ጉዳት የደረሰ እንደሆነ፣ ጉዳት ያደረሰው ወገን ካሣ የመክፈል ኃላፊነት ያለበት (የሚኖርበት) ስለመሆኑ፣ አዋጅ ቁ. 65/1936 አንቀጽ 2(ሀ) አዋጅ ቁ. 66/1936 አንቀጽ 1(ለ) አዋጅ ቁ. 455/1997,የኤ.ፌዲሪ ህገ መንግስት አንቀጽ 40(8)
