በ ትምህርት ደረጃው ከፍተኛ የሆነና በባህሪው ለህብረተሰብ አርአያ ሊሆን የሚገቡ ሰዎች ፍፁም ነውረኛ በሆነና ጨካኝነት በተሞላበት ሁኔታ የፈፀሙት ከባድ የወንጀል ድርጊት የወንጀል አፈጻጸሙን ከባድነት እና የወንጀለኛውን አደገኛነት የሚያሳይ በሆነ ጊዜ ወንጀለኛው ላይ የቀረበ የቀደመ የወንጀል ሪከርድ ያለመኖር ወንጀለኛው ጥሩ ፀባይ ወይም መልካም ፀባይ ያለው ነው የሚል ግምት ለመውሰድ የማያበቃ ስለመሆኑ፣ -የወ/ህ/ቁ. 184/1/ሀ/ እና ለ ቁ. 539 ቁ. 671/1/0/ የፌ/ጠ/ፍ/ቤት የቅጣት አወሳሰን መመሪያ ቁ. 2/2006 የኢ.ፌ.ዲ.ሪፐብሊክ ሕገ መንግስት በአንቀጽ 15 እና የወ/ህ/ቁ. 117
