ከመደበኛ ፍ/ቤት ውጭ አንድን ጉዳይ የማየት የዳኝነት ስልጣን የተሰጠው አካል ጉዳዩን ማየት እንደማይቻል ገልጾ ከመለሰው ጉዳዩን የማየት ስልጣን ለሌላ አካል ተሰጥቷል የሚል ክርክር እስካልቀረበበት ድረስ መደበኛ ፍ/ቤቱ ይህን ጉዳይ ማየት አልችልም በሚል መመለስ የማይቻል ስለመሆኑ
የፕራይቬታይዜሽን ኤጀንሲ በኤጀንሲው የሚታይ ጉዳይ አይደለም በሚል አረጋግጦ የመለሰው ጉዳይ በስልጣኑ ላይ ሌላ ክርክር እስካልቀረበበት ድረሰ ፍ/ቤቶች ተቀብለው ማስተናገድ ያለባቸው ስለመሆኑ
